Welcome and thank you for your interest in Messy Buns Ltd and our online ordering service at www.messybunsireland.ie. The terms and conditions set out below apply to online orders for collection/delivery for the supply of products by us (“Order(s)”), that are submitted via our online ordering service at www.messybunsireland.ie (“Service”).
The Service is operated by Messy Buns Ltd (“we”, “our” or “us”, “the company”). We are a company registered in Ireland with Company Registration Number 672975 at No. 98 Main Street, Midleton, Co. Cork.

Please read these terms carefully before ordering as these terms will apply to any orders you place online using the Service. By placing an order using the Service, you acknowledge that you have read, understood, and agree to be bound by these terms. If you do not accept these terms and conditions, you should not place an order. By using this website and providing information during the Service, you are consenting to the use of the information as described in the Privacy and Cookie Policy, please click here to review.

PLACING ORDERS
To submit an Order and use the Service, you warrant that:
a. You are at least 18 years old;
b. You are legally capable of entering into binding contracts;
c. All information given to us is true and correct.
You acknowledge that Orders can only be placed for collection/delivery at the designated location(s). When placing an Order, collection/delivery point and respective collection/delivery times are made available during the checkout process for you to choose and select the time of your order.

Collection/delivery points and respective times available during the checkout process may change at any time without prior notice. Please only submit an Order if you intend to collect/receive the Order at the selected location & time.
To place an Order via the Service, you will be required to specify:
a. The products and quantity thereof that you wish to order (Your Order), from the list of products available on the Service.
b. The collection/delivery location & time; and
c. Any other required information to finalize and subsequently identify your Order, including but not limited to your name and email address.
Ordering is subject to a minimum amount, cut-off times, and may be subject to capacity together with individual maximum order amounts per product. When placing an Order, the system will follow any cut-off, capacity, or other rules such that collection/delivery points, collection or delivery days/times, the availability of certain products may or may not be available to you at the time of checkout. A notice concerning the rules is maintained on the online shop.

While browsing the categories of our shop, each available product is listed, and it is possible to add or remove a product directly to or from the basket. At any time, you can open your basket to change the quantity of any product in your basket.
On checkout, please ensure that you revise thoroughly all the details you have entered and correct any errors before submitting your Order. Prior to payment processing, you will be presented with a final Order review before being directed to our payment processor.

You will be able to cancel or vary your Order as allowed under clause “Change & Cancellations”. After completing payment, you will be presented with a screen confirming your order has been received by us (the “Confirmation Screen”). Should there be any issue at this point in the process, you will be notified on the Confirmation screen. You will also receive an automated confirmation email detailing your payment transaction identifier, order reference, collection/delivery details, and an itemized summary of your order, including the total payment made.

Please make sure the email address you have provided is correct, and your mailbox is in proper working order, as all correspondence regarding your order will be sent to this address. If you do not receive the confirmation email within a few minutes of submitting the order, please check your junk/spam folder, as your email server rules may direct the email to one of these folders. Adding messybunsorders@gmail.com to your email client address book will guarantee that you receive these emails. If you have any issues, please email us.

DELIVERY/COLLECTION & TIME SLOTS
Prior to checkout, the order is selected as being either for Collection or Delivery, and a time slot is also chosen. Delivery charges are applicable and added to the order cost before checkout. To qualify for delivery, the delivery address must be within our delivery area.

RECEIVING AN ORDER – DELIVERY
Orders for delivery will be delivered to the address as specified at the time of your order. Best effort is made to deliver within the timeframe. Please note that a contact phone number is required for delivery.

COLLECTING AN ORDER – COLLECTION
Orders must be collected from the collection point and orders can only be collected within the relevant location’s opening hours and from the time selected at checkout.
Please arrive at the collection point and let a member of the team know the order reference number attached to your Order. Any other information regarding the collection of your order will be notified in the confirmation email.
No refunds will be given for uncollected items. Credit vouchers may be issued only at the discretion of Messy Buns.

PRODUCT PRICING
The prices published on the Service will apply to the Ordered Products. All prices stated on the Service are inclusive of VAT. Prices may change from time to time without prior notice but changes will not affect confirmed orders.
We reserve the right to refuse an Order or alter the agreed price if an incorrect price was given due to technical or human error.

PAYMENT
Payment for your Order is made Online at the time of submitting your Order, using a debit or credit card. During checkout you will be asked to supply the billing name and address for the card being used to make the online payment with Stripe. This information is required to complete the online payment.
We do not, however, store this information on our servers excepting the name which is used to identify the order. You can opt to store on your device your email address, phone number, and card billing address for re-use with our service. This online payment processing service is being provided by a third party payment provider, Stripe. The personal information (credit or debit card details), which you provide to this third party, is never stored on our systems. As such, this information is subject to the privacy and data retention policies of the payment provider being used. We will accept no responsibility for any loss or damage that may arise from your use of their services.

CANCELLATIONS & REFUNDS

CHANGES & CANCELLATIONS BY YOU

Changes: Alterations to orders may be requested but we may not be able to accommodate late changes. Additional charges may apply for any changes. You may request to alter your order prior to the appointed time slot. To alter your order contact us directly by telephone at your chosen collection point.

Cancellations:
You may cancel an entire order or part of an order according to the following terms:
a. Cancellation requests can be made any time before the appointed time by phoning the 021 4633861. No changes or cancellations will be accepted after this time.
b. Where an entire order I part of an order is cancelled by you before the cancellation deadline we will not provide any cash refund but we will provide you with a credit voucher in the same amount that is usable on your subsequent online order. The credit voucher will be sent to you by email, at the email address provided when you submitted the order.

CHANGES & CANCELLATIONS BY US
If we are unable to fulfill your Order due to unforeseen circumstances, or if one of the products is no longer available, we will endeavor to contact you to cancel or vary your order before the time, otherwise, we will do our best to resolve the issue when you arrive at the collection point/prior to delivery time.
In such case we will determine whether it is appropriate to:
• Replace the unavailable item with another item of a similar value; or
• Cancel the entire Order and provide a full refund to the value of your Order; or
• Provide a credit voucher to the value of the unavailable item(s).
Any payment made prior to an order being canceled by us will typically be reimbursed using the same method originally used by you to pay for your order. A refund will be for the amount actually paid taking into account any offer or discount that may have been used.

CREDIT VOUCHERS
The following conditions apply to vouchers issued by us:
• Vouchers are issued at our sole discretion by email in the form of an email and code combination.
• Vouchers are not subject to an expiry date.
• Vouchers can only be redeemed on the Service.
• Vouchers are non-refundable, non-transferrable, and it is the burden of the bearer to keep the voucher safe.
• Vouchers can only be used singly, and multiple vouchers are not accepted at checkout.
• The voucher can only be redeemed on checkout using the same email and code combination as issued.
• The voucher amount will be deducted from the checkout total with the remaining balance (if any) to be paid online.
• The voucher balance will update when you proceed to “Make payment” deducting the checkout total from the voucher balance with any remaining balance available.
• After completing an order, the voucher balance and transaction history are displayed on the validation page and in the confirmation email sent with the order.
• Due to minimum payment processing amounts, where the amount to be paid (the difference between voucher balance and checkout total) is not possible, the voucher when reduced to a balance of is no longer usable.

GIFT VOUCHERS
The following conditions apply to gift vouchers:
• Vouchers are not subject to an expiry date.
• Vouchers can be redeemed at our physical point of sale and online.
• Vouchers are non-refundable, and it is the burden of the bearer to keep the voucher safe.
• Vouchers can only be used singly, and multiple vouchers are not accepted at checkout.
• The voucher amount will be deducted from the checkout total with the remaining balance (if any) to be paid.
• When the voucher is redeemed, the balance is updated, and any remaining balance will be available on the next redemption.
• After completing an online order, the voucher balance and transaction history are displayed on the validation page and in the confirmation email sent with the order.
• Due to minimum payment processing amounts, where the amount to be paid (the difference between voucher balance and checkout total) is less than the use of the voucher is not possible, the voucher when reduced to a balance of is no longer usable.
• Please note that large orders must be notified in advance when using a voucher for redemption.

PRODUCTS
All Products displayed are subject to availability. In most cases, we will offer an alternative for any out-of-stock item.
We endeavor to provide information on any allergens that the Products may contain on our Website, but please note that:
• We cannot guarantee and we make no warranty that the Products will not contain any allergens.
• Our restaurant is a busy working environment, and there is a risk of cross-contamination between ingredients; if you have an allergy, we kindly ask that you do not order online. In this scenario, please telephone or email us. For allergy information, please visit the Food Safety Authority of Ireland.

• Products may vary slightly from their pictures. The images of the Products on our website are for illustrative purposes only.
Although we have made every effort to display the Products accurately, we cannot guarantee that a Product is accurately reflected on the device in use by you. Product packaging may vary. The packaging of the Products may vary from that shown on images on our website.
We have a 100% satisfaction guarantee. If you are not happy with your experience, please email us here, and we will work to resolve your concerns. Any complaint must be submitted to us for consideration within 24 hours of the order time slot along with your order number. We will review your request and revert as soon as possible.
Any decision to grant a refund or a credit voucher will be at our sole discretion.

NO RESALE OR THIRD PARTY PROVIDERS
The Service is only open for Orders made on a direct-to-customer basis. Orders are only accepted on the condition that the person who places the Order must collect the Order in person for the purposes of private consumption. You must not resell or resupply any Products ordered via the Service to a third party.
We may refuse, without any refund, any Order submitted via the Service which we reasonably believe has been made by or through a third-party delivery business.

DISCLAIMERS
We do our best to ensure that our product names, descriptions, prices, nutritional information, and allergenic warnings are accurate, but we accept no liability if any of the details published on the Service are incorrect, out-of-date, or incomplete.
If you have any doubt about the contents of any of our products, allergy warnings, or any other information, please contact us before you place your Order. These Online Ordering Terms will apply to the extent permitted by law and none of these terms will be construed as excluding, qualifying, or limiting your statutory rights or remedies.
We do not guarantee that Messy Buns will accept and fulfill all Orders, and Messy Buns has the discretion to reject Orders at any time because they are at operational capacity.

EVENTS OUTSIDE OUR CONTROL
We will not be liable or responsible in respect of anything that may constitute a breach of the terms by reason of Force Majeure, namely circumstances beyond our control, that prevent or limit our ability to perform our obligations pursuant to these terms. A Force Majeure Event includes any act, event, non-happening, omission, or accident beyond our reasonable control. Circumstances which constitute force majeure shall include (but shall not be limited to) acts of God, fire, flood, earthquake, explosion, sabotage, accident, embargo, riot, civil commotion, epidemic, computer virus, breakdown of equipment, and failure of electrical supply or telecommunications links, non-performance by suppliers or subcontractors.

WEBSITE ACCESS
While we try to ensure the Website is normally available twenty-four (24) hours a day, we do not undertake any obligation to do so, and we will not be liable to you if the Website is unavailable at any time or for any period.
